These Terms of Use (the "Terms") govern your access to and use of datastrat.ai and any other website that DataStrat LLC operates and that links to these Terms (each, the "Site"). DataStrat LLC is a Texas limited liability company ("DataStrat," "we," "us," or "our").
By using the Site, or by signing up through it, you agree to these Terms. If you do not agree, do not use the Site.
IMPORTANT: Section 17 contains an agreement to resolve disputes by binding individual arbitration, and a waiver of class actions and jury trials, for users in the United States. You can opt out of it within 30 days. Section 17 does not apply to consumers in the European Economic Area (the "EEA"), the United Kingdom (the "UK"), or Switzerland.
1. Who may use the Site
The Site is for business professionals. You must be at least 18 years old to use it. If you use the Site for your work, you are responsible for following your employer's policies.
2. Signing up
When you sign up through the Site:
⚬ You must give accurate information about yourself, and only your own information;
⚬ You must use a work email address that you are authorized to use;
⚬ You sign up in your own name and in your professional capacity. Signing up does not bind your employer to anything, does not create any obligation to buy, and does not make you or your employer our customer; and
⚬ You join the ARIA Early Access Program (the "Program"). The ARIA Early Access Program Terms apply to the Program and form part of these Terms.
We may refuse or cancel any sign-up, for example if we believe that it is fake, automated, or made in breach of these Terms.
3. Your license to use the Site
Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your own information or for your organization's internal business information. We reserve all rights that we do not expressly grant to you.
4. Things you must not do
You must not, and you must not help anyone else to:
⚬ Copy, sell, license, distribute, or commercially exploit the Site or its content, except as these Terms allow;
⚬ Use robots, scrapers, crawlers, or other automated means to access the Site or to collect information from it, except for public search engines that follow our robots.txt file;
⚬ Use the Site or its content to develop, train, fine-tune, test, or benchmark artificial intelligence or machine learning models, or for text and data mining. We expressly reserve these rights, including for the purposes of Article 4(3) of EU Directive 2019/790;
⚬ Copy, modify, decompile, reverse engineer, or create derivative works of the Site or its software, except as the law expressly allows;
⚬ Probe, scan, or test the vulnerability of the Site, or breach or bypass any security or authentication measure;
⚬ Interfere with or disrupt the Site, or place an unreasonable load on it;
⚬ Submit false or misleading information, or information about another person;
⚬ Upload or transmit viruses, malware, or other harmful code;
⚬ Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
⚬ Use the Site to build or support a competing product or service;
⚬ Remove or change any copyright, trademark, or other proprietary notice; or
⚬ Use the Site in breach of any law or of the rights of others.
5. Our content and trademarks
The Site and its content, including text, graphics, videos, software, and design, belong to DataStrat or its licensors and are protected by intellectual property laws. "DataStrat," "ARIA," and our logos are trademarks of DataStrat. You may not use them without our prior written permission.
6. Third-party frameworks and trademarks
The Site refers to industry frameworks, standards, and products that belong to others. DCAM and CDMC are trademarks or registered trademarks of EDM Council, Inc. (doing business as EDM Association). All other names and marks belong to their owners. We use these names only to identify the frameworks and products that we refer to. DataStrat is not affiliated with, sponsored by, or endorsed by the owners of these frameworks or marks, and our content and assessments are not official, certified, or approved by them. These Terms do not give you any rights in third-party frameworks or marks.
7. Information only, not professional advice
The content on the Site, including articles, videos, demos, sample outputs, maturity scores, and benchmarks, is general information. It is not legal, regulatory, compliance, audit, accounting, security, or other professional advice, and it does not create an advisory or other professional relationship. We do not promise that using ARIA or our content will make your organization compliant with any law, regulation, or standard (for example, BCBS 239 or the GDPR). Get advice from qualified professionals before you act on any content.
8. AI-generated content and ARIA
We may use artificial intelligence tools to create or edit some content on the Site, such as text, images, video, and voice-overs. Where the law requires it, we label AI-generated or AI-manipulated audio and video. ARIA uses artificial intelligence. Demonstrations and sample outputs may be simplified or based on fictional data, and they may differ from actual results. AI outputs can be inaccurate or incomplete, and people with suitable expertise should review them before anyone relies on them.
9. Feedback
If you give us feedback or suggestions, we may use them for any purpose, without any obligation to you. You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, copy, modify, and otherwise exploit them. Do not give us feedback that you consider confidential.
10. Privacy and cookies
Our Privacy Policy explains how we collect, use, and share personal information. Our Cookie Notice explains how we use cookies and similar technologies. If these Terms and the Privacy Policy conflict on how we handle personal information, the Privacy Policy controls.
11. Third-party websites and services
The Site may contain links to websites and services that third parties operate, such as LinkedIn or event platforms. We do not control them and are not responsible for them. Their own terms and privacy policies apply when you use them.
12. Changes to the Site and to these Terms
We may change, suspend, or stop the Site, or any part of it, at any time. We may update these Terms. We will post the updated Terms on the Site and change the effective date. If a change is material, we will give notice by email (if we have your email address) or through a clear notice on the Site before the change takes effect. If you continue to use the Site after a change takes effect, you accept the updated Terms. Changes to Section 17 take effect 30 days after we post them, apply only to Disputes that arise after that date, and do not apply to any Dispute that either party knew about before that date.
13. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL BE FREE OF VIRUSES OR OTHER HARMFUL CODE.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
⚬ DATASTRAT AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND
⚬ OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, SUCH AS LIABILITY FOR FRAUD OR, WHERE THE LAW SO PROVIDES, FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.
15. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless DataStrat and its members, managers, employees, and contractors from and against any claims, losses, and reasonable costs (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site. We will notify you of any such claim, and we may take control of its defense. You may not settle any such claim without our prior written consent.
16. Governing law and courts
The laws of the State of Texas, without regard to its conflict-of-laws rules, govern these Terms and any dispute arising out of or relating to them or to the Site. The Federal Arbitration Act governs Section 17. Subject to Section 17, the state and federal courts located in Travis County, Texas, have exclusive jurisdiction over any dispute, and you and we consent to their jurisdiction. If you are a consumer in the EEA, the UK, or Switzerland, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts of that country.
17. Dispute resolution by arbitration (U.S. users)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO SUE IN COURT AND TO HAVE A JURY TRIAL.
17.1 Applicability
This Section applies if you live in the United States. You and DataStrat agree to resolve any dispute, claim, or controversy arising out of or relating to the Site, these Terms, or the ARIA Early Access Program (a "Dispute") by binding individual arbitration, and not in court. However, either party may (a) bring an individual claim in small claims court if the claim qualifies, and (b) ask a court for an injunction or other equitable relief to protect intellectual property rights or to stop unauthorized access to the Site. This Section also applies to Disputes that arose before you agreed to these Terms.
17.2 Informal resolution first
Before either party starts an arbitration, that party must send the other a written notice that describes the Dispute and the relief requested. Send notices to DataStrat at legal@datastrat.ai or at the mailing address in Section 19. We will send notices to the email address you gave us. Within 45 days after the notice is received, the parties will meet by telephone or video conference and try in good faith to resolve the Dispute. If the Dispute is not resolved within 60 days after the notice is received, either party may start arbitration. All limitation periods are suspended from the date the notice is received until 60 days after that date.
17.3 Rules and administration
JAMS (www.jamsadr.com) will administer the arbitration under its Streamlined Arbitration Rules and Procedures for claims of less than US$250,000 (excluding attorneys' fees and interest), and under its Comprehensive Arbitration Rules and Procedures for larger claims, together with the JAMS Consumer Arbitration Minimum Standards where they apply. A single arbitrator will decide the Dispute. Hearings will take place by video conference, unless the arbitrator decides that an in-person hearing is necessary. Any in-person hearing will take place in the county where you live, unless both parties agree otherwise.
17.4 Fees
If you are an individual, DataStrat will pay all JAMS filing, administrative, and arbitrator fees, except for the filing fee that a consumer would pay under the JAMS Consumer Arbitration Minimum Standards, whether or not those standards apply. Otherwise, the JAMS rules govern the payment of fees. Each party pays its own attorneys' fees, unless the arbitrator finds that a claim was frivolous or brought for an improper purpose, or the law provides otherwise.
17.5 Authority of the arbitrator
The arbitrator decides all issues, including the scope and enforceability of this Section, except that a court decides:
⚬ Any challenge to the class action waiver in Section 17.7;
⚬ Disputes about arbitration fees;
⚬ Whether the informal resolution requirement in Section 17.2 was met; and
⚬ Which version of these Terms applies.
The arbitrator may award the same individual relief that a court could award. The award is final and binding, and any court with jurisdiction may enter judgment on it.
17.6 Jury trial waiver
YOU AND DATASTRAT WAIVE ANY RIGHT TO A JURY TRIAL FOR ANY DISPUTE.
17.7 Class action waiver
YOU AND DATASTRAT MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may award relief only to the individual party that seeks it. If a court finds this class action waiver unenforceable for a particular claim, that claim, and only that claim, must be brought in the courts described in Section 16, and it will be stayed until the arbitration of any other claims is complete.
17.8 Batch arbitration
If 25 or more substantially similar demands for arbitration are filed against DataStrat within a 90-day period by or with the assistance of the same law firm or coordinated group, the parties agree that JAMS will administer them in batches of up to 25 demands. One arbitrator will decide each batch in one proceeding, with one set of fees for each batch. Limitation periods are suspended for each demand until its batch begins. A court decides any dispute about whether or how this Section 17.8 applies, including if JAMS declines to administer the demands in batches.
17.9 Opt-out
You may opt out of this Section 17 by sending notice to legal@datastrat.ai, or to our mailing address in Section 19, within 30 days after you first agree to these Terms. Your notice must include your name, your email address, and a clear statement that you want to opt out of arbitration. Opting out does not affect any other part of these Terms.
17.10 Severability
If any part of this Section 17, other than Section 17.7, is found to be unenforceable, the rest of this Section remains in effect.
18. General
⚬ Entire agreement: These Terms, including the ARIA Early Access Program Terms, are the entire agreement between you and us about the Site. Our Privacy Policy and Cookie Notice explain our practices. They are notices, not part of this agreement.

⚬ Electronic communications: You agree that we may communicate with you electronically, and that electronic communications satisfy any legal requirement that a communication be in writing.
⚬ Sanctions and export control: You may not use the Site if you are located in a country or region subject to comprehensive U.S. sanctions, or if you are named on a U.S. government list of restricted parties.

Terms of Use
Effective: October 20, 2026 | Last updated: October 20, 2026

⚬ You must give accurate information about yourself, and only your own information;
⚬ You must use a work email address that you are authorized to use;
⚬ Copy, sell, license, distribute, or commercially exploit the Site or its content, except as these Terms allow;
⚬ Use robots, scrapers, crawlers, or other automated means to access the Site or to collect information from it, except for public search engines that follow our robots.txt file;
⚬ Use the Site or its content to develop, train, fine-tune, test, or benchmark artificial intelligence or machine learning models, or for text and data mining. We expressly reserve these rights, including for the purposes of Article 4(3) of EU Directive 2019/790;
⚬ Copy, modify, decompile, reverse engineer, or create derivative works of the Site or its software, except as the law expressly allows;
⚬ Probe, scan, or test the vulnerability of the Site, or breach or bypass any security or authentication measure;
⚬ Interfere with or disrupt the Site, or place an unreasonable load on it;
⚬ Submit false or misleading information, or information about another person;
⚬ Upload or transmit viruses, malware, or other harmful code;
⚬ Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
⚬ Use the Site to build or support a competing product or service;
⚬ Any challenge to the class action waiver in Section 17.7;
⚬ Disputes about arbitration fees;
⚬ Severability and waiver: If a court finds any provision of these Terms unenforceable, the provision will be enforced to the maximum extent permitted, and the other provisions remain in effect. If we do not enforce a provision, that does not waive our right to enforce it later.
⚬ Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms, including in connection with a merger, acquisition, or sale of assets.
⚬ Language: If we translate these Terms, the English version controls.
⚬ Notice for California users: Under California Civil Code Section 1789.3, California users are entitled to the following notice: The Site is provided by DataStrat LLC, 5900 Balcones Drive, Suite 100, Austin, TX 78731, United States. To file a complaint about the Site or to receive more information about it, contact us at legal@datastrat.ai or at that address. ⚬ Accessibility: We want the Site to be accessible to everyone, including people with disabilities. We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.2, Level AA. If you have difficulty using any part of the Site, contact us at legal@datastrat.ai, and we will try to help.
